Medical Marijuana Facility License

NOTE:  The MO Dept. of Health and Senior Services (DHSS) has announced the following tentative dates for the issuance of State medical marijuana facility licenses.   The appropriate license issued by the DHSS is a prerequisite to the issuance of a City of Columbia medical marijuana facility business license.

Chapter 13, Columbia Code of Ordinances

It shall be unlawful for any person, either personally or through the use of agents or employees, to engage in the cultivation, manufacturing, dispensing, selling, or testing of medical marijuana within the city, without the appropriate licenses issued by the Department of Health and Senior Services and the City of Columbia.  (Article XIII, Section 13-421, Columbia Code of Ordinances)

How do I apply for a Medical Marijuana Facility Business License?

There are four (4) types of medical marijuana facility business licenses: (1) medical marijuana cultivation facility license, (2) medical marijuana dispensary facility license, (3) medical marijuana-infused products manufacturing facility license, and (4) medical marijuana testing facility license.  Applications for Medical Marijuana Facility Business Licenses may be obtained here or from the City Business License Division located at 701 East Broadway, 5th Floor.  Email:  business.license@como.gov or call 573.874.7378 or 573.874.7549.

A medical marijuana facility license application and a criminal record check are required for each applicant as well as the manager who will be in charge of the facility.   If the application is made on behalf of a partnership, the applicant shall be all partners.  If the application is made on behalf of a corporation, the applicant shall be all officers, directors, stockholders who own at least 10% of the corporation.  If the application is made on behalf of a limited liability company, the applicant shall be all members and managers.  Each applicant shall complete a Disclosure and Authorization Form to Obtain a Missouri Background Report and, if necessary, a Disclosure and Authorization Form to Obtain an Out-of-State Background Report.   Please contact the Business License Office to receive fee information for out-of-state record checks.

No person shall be granted a license unless the person is a resident of the State for at least one (1) year prior to application.    

A Certificate of No Sales Tax Due shall be provided at the time of application, which can be obtained from the MO Department of Revenue at 573.751.9268 or taxclearance@dor.mo.gov.

A City of Columbia Medical Marijuana Facility Business License must be posted in a conspicuous location at the medical marijuana facility.

In the event the application is denied, the applicant will be notified and may appeal the denial to the medical marijuana facility license review board.

What is the term of a Medical Marijuana Facility Business License?

Medical Marijuana Facility Business Licenses shall be issued for a period of one (1) year from January 1 through December 31. 

What is the cost to obtain an initial Medical Marijuana Facility Business License?

The application shall be accompanied by payment of a $2,000.00 processing fee, a $17 fee to obtain a Missouri criminal record check (additional cost if out-of-state criminal record check is needed), and a business license fee based upon estimated gross receipts:

  • Gross receipts not exceeding $25,000 — $15.00 fee
  • Gross receipts above $25,000 but less than $100,000 — $25.00 fee
  • Gross receipts above $100,001 — $0.25 for every $1,000 of gross receipts above $100,000, to a maximum fee of $750.00

Medical Marijuana Dispensary Facility License Approval Process:

  • The number of medical marijuana dispensary facility business licenses issued shall be limited to one (1) per twenty thousand (20,000) population.
  • Applications will be accepted for a period of twenty-one (21) days after the Missouri Department of Health and Senior Services has issued its license for the medical marijuana dispensary facility.  All applications will be reviewed within 60 days after the initial application filing period.  Applications filed after the close of the application filing period will be based on the availability of licenses.

Annual Renewal of Medical Marijuana Facility Business Licenses:

Applications for license renewals shall be submitted to the City Business License Division no later than October 1 together with a renewal processing fee of $500.00.  If a renewal application is not submitted on or before October 1, a late charge shall be added to the renewal fee as follows: 

October 2 to October 31 — $100.00
November 1 to November 30 — $200.00
December 1 to December 31 — $300.00

If not submitted by December 31, an automatic forfeiture of the license shall occur.
